Our Senior Immigration Consultant, Mr Eustace Okere has this week won a number of appeal cases at the Asylum and Immigration Tribunal (AIT) in Nottingham and Stoke-on-Trent against the entry clearance officer’s refusal decisions to grant as many as fifty NVQ students visa applications in India.
These are just a few of a number of NVQ cases that HCI Immigration Consultants have appealed against now scheduled to be heard by the AIT until November 2009.
All the refusal letters seemed to look like they were just being duplicated and printed out with just one paragraph usually saying “the course you plan to study does not seem to be realistic or in line with your previous pattern of study or employment...” even though the appellants have previously studied nursing or healthcare related courses.
This again demonstrates the need for proper immigration advice as most genuine students are constantly being refused visa to travel to the United Kingdom as result of lack of competent immigration advice and representation.
This is also the case with the newly introduced points based system which unfortunately does not attract any right of appeal. Applications are being refused just for not submitting appropriate passport photos and copies of supporting documents – mistakes which would have been easily avoided.
